Please read these Terms before using “my温泉手帳” (the “Service”). By creating an account, you are deemed to have agreed to these Terms.
1. Purpose and Scope
The Service aims to contribute to the appreciation of hot spring (onsen) culture by visualizing, recording, and sharing onsen water analysis reports. Anyone in or outside Japan may browse the Service, but the analysis-report upload feature is intended for reports posted at onsen facilities within Japan.
2. Account Registration
- Please provide accurate information.
- Each user may hold only one account.
- You are responsible for safeguarding your password.
- Users under 13 (under 16 for EU residents) require the consent of a parent or guardian.
3. Data Sources and Candidate Onsen
Data on onsen facilities and candidate onsen shown in the Service is based primarily on OpenStreetMap (OSM) (OSM data is licensed under ODbL).
- Because coverage depends on OSM, some existing onsen facilities may not yet be registered in the Service.
- If a search does not return the onsen you are looking for, you may register it yourself by uploading an onsen analysis report.
- Registered information is used to provide and improve the Service within the scope of these Terms.
4. User Content and Rights
When uploading images or text of onsen analysis reports, please confirm the following.
- That you hold the rights necessary to upload the content, or that the content may otherwise be used lawfully.
- We interpret the photographing and sharing of analysis reports posted at onsen facilities under Article 18 of the Hot Springs Act as permissible within the Service’s purpose (providing information in the public interest); however, please follow each facility’s policy.
- You are deemed to grant a license to use your content to the extent necessary to provide and improve the Service.
- Please refrain from posting images that can identify specific individuals.
5. Prohibited Conduct
- Posting false or inaccurate information
- Posting content that infringes others’ copyrights, trademarks, or privacy rights
- Posting images containing personal data (names, addresses, phone numbers, etc.)
- Spam, repeated bulk posting, or overloading the Service
- Unauthorized access, tampering, or reverse engineering
- Commercial solicitation or advertising through the Service without permission
- Any act that violates laws or public order and morals
6. Content Moderation
The Service reserves the right to remove or hide inappropriate content without prior approval. We may also suspend or delete accounts found to be in violation.
7. Disclaimer
- The Service is provided “as is.” We do not warrant the accuracy or completeness of its data.
- Information about onsen components and benefits is for reference only and must not be used for medical decisions.
- The accuracy of analysis reports posted by users is the responsibility of the poster.
- We are not liable for any damages arising from interruption, modification, or termination of the Service.
8. Changes and Termination
The contents of the Service may be changed, suspended, or terminated without prior notice. We will announce material changes within the Service or by email to your registered address.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for disputes relating to the Service. (Operator information and jurisdiction details: in preparation)
10. Changes to These Terms
These Terms may be revised as necessary. For material changes, we will provide notice before the effective date. Continued use after a revision is deemed acceptance of the revised Terms.
